Executive Director <br />8120 Gage St. Loretta Pineda <br />Frederick, CO 80516 Director <br />Re: Western Sugar Reclamation Land Development Project, Revision Denial, Permit No. M- <br />2010 -049, Technical Revision Denial, Revision No. TR -04 <br />Dear Mr. Varra: <br />On August 13, 2013 the Division of Reclamation, Mining and Safety (Division) consider your <br />request for the Western Sugar Reclamation Land Development Project, addressing the following: <br />Technical Revision to change post- mining land use from Industrial /Commercial to <br />Developed Water Resource by clay lining the ponds <br />The Division denied your Technical Revision request. The reasons for denial are outlined below: <br />The proposed change in post- mining land use requires the submittal of an amendment <br />application since significant changes to the Mining Plan, Reclamation Plan and compliance <br />with Rule 3 of the Mineral Rules and Regulations are needed for the change from <br />Industrial /Commercial to Developed Water Resource.
