Tom Kaldenbach LI/
State of Colorado
Division of Reclamation, Mining and Safety
1313 Sherman Street
Denver, CO 80203
July 20`h, 2013
Dear Tom;
My name is Todd Sullivan. I am 50% owner of the Rock N Pine gravel pit located at 49001 Hwy 9
Fairplay, Colorado. I understand that you visited our property on Friday for your inspection. I am
disappointed that I was not contacted so that I could participate in your findings. I was told by Mark
Balderson that you have some issues on the property and I would like to discuss these with you in
person. Please contact me at 863 - 660 -0763. 1 want to clarify that I am trying to be in compliance with
Garver Brown and my mining water 2 cubic ft per second 1867 sacramento ditch; which requires the
completion of the pipeline and approval by Garver before we can operate the plant. I have been making
bedding to fill the trench.
All the material 3/8 minus has been used on the pipeline. There is a pile of 1 % beside the dump truck
that has been produced by screening aggregate over my grizzly which is part of the permit.
I started to put the road in down the side of the hill so the dump truck can safely carry the slash pile
(fire hazard) to the end of the property. Mark came to me and said there might be a problem with the
road; so all construction stopped. I placed a call to you on June 27`h or 28`h, 2013 asking you to call me so
that I could request your permission to put in the road. Please check your call log to verify. The hillside is
solid bedrock and I need to make a path wide enough for the machines to traverse safely. I am afraid of
the road straight down the hill.
There is no intent to violate any terms of our permit; and I ask to be allowed to continue to make the
bedding for the pipeline. I wish I could have discussed this with you in person. Please put me on your
contact list for future concerns.
Si
r
Todd Sullivan
863 - 660 -0763
toddsull @hotmail.com
RECEIVED
AUG 01 2013
DIVISION OF RECLAMATION
MINING AND SAFETY
