Dear Mr. Schafer:
On July 18, 2013, the Division of Reclamation Mining and Safety received your 112CO construction
materials conversion application. Preliminary review of the information received determined that
the following items must be received before the Division can consider you application as being filed
and technical review can begin.
Under Rule 1.4.5(2), (b) (v); the operator has to provide; proof of notice sent to the local Board of
County Commissioners and the local Soil Conservation District according to the provisions of
subsection 1.6.2 (1) (a) (i) (ii). However there is no proof included in the form of a certified return
receipt or a date stamped copy of the notice with the application. Please provide the required proof
to verify that the Notices were sent in accordance with Rule 1.6.2(1) (a) (i) (ii). The only
information provided with the application is a notice with a delivery tracking confirmation date
that shows the notices were delivered. ;
Please provide proof that the required sign is posted in accordance with Rule 1.6.2(b). No proof of
posted sign was included with the application.
Under page 3 of the application page, the address for the Dumb and Dumber Trucking, LLC is listed
in Sterling Colorado, which is in Logan County. However, on page 8 of the signature page, the Dumb
and Dumber Trucking, LLC is listed in Phillips County. Please explain and submit a new signature
page with the correct county.
Exhibit A- Legal Description 6.4.1
Please provide the legal description in accordance with Rule 6.4.1(1) (2). The description provided
does not meet the requirements of the Rule. The legal description must identify the affected land,
specify affected area and be adequate to field locate the property.
