Box 483 Director <br />Paonia, CO 81428 <br />Re: Bowie No. 2 Mine (Permit No. C- 1996 -083) <br />2nd Quarter 2013 Coal Mine Waste Bank Inspection and Instrumentation Monitoring <br />Dear Mr. Bear: <br />The Division has received and reviewed BRL's report on the 2 d Quarter 2013 Coal Mine Waste Bank <br />Inspection and Instrumentation Monitoring for the Bowie No. 2 Mine. The report included all of the <br />information required by Rules 4.10.1 and 4.09.1(11), and noted no appearance of instability, structural <br />weakness, or other hazardous conditions. <br />The report identifies three areas where slopes are steeper than the approved 2.5:1 configuration, but <br />indicates that the steeper areas are a result of BRL end dumping material through the winter months. <br />BRL is currently working to correct these slopes. <br />The report indicates that 73 of 74 compaction tests passed. Two previous test failures (from the third <br />and fourth quarters of 2012) were not retested since no work was performed in that test failure area. <br />The Division will monitor future reports to verify that the failed test locations (738, 755/755A/755B, and <br />843) are retested and properly compacted. <br />The instrumentation monitoring section of the report (page 2 of the Buckhorn report), first paragraph of <br />the Vibrating Wire Piezometer section, does not describe when VWP -09 and -10 were installed. <br />According to the chart accompanying the report, quarterly measurements were made at VWP -09 and - <br />10 beginning in June 2012. Locations of these VWP's are not identified on the drawing on page 50. <br />Please update the language and map of the report to address the installation of these two <br />instrumentation sites. <br />If you have any questions or need additional information, please contact me. <br />Sincerely, <br />Susan L.
