Pineda <br />5731 State Highway 13 Director <br />Meeker, CO 81641 <br />Re: Colowyo Coal Mine (Permit No. C- 1981 -019) <br />Bond Release Application No. 7 (SL -07), Adequacy review <br />Dear Mr. McCourt: <br />The application for SL -07 was deemed complete for the purposes of filing on May 14, 2013, and the <br />bond release inspection of the site was conducted on May 21, 2013. DRMS staff has reviewed your <br />bond release application and the results of the inspection to determine whether the items you have <br />submitted are adequate in terms of meeting the requirements of the Act and Regulations. During the <br />inspection, adequacy issues were identified in the bond release area. Some reclamation features are in <br />the West Pit parcels (WP018 and WP019) that are proposed for Phase I release. These include a pile of <br />rocks, a scraper road, and a topsoil stockpile (perhaps two). <br />Within parcel WP018, there is a pile of rocks that have been stockpiled for constructing channels, and <br />there is a topsoil stockpile that needs to be spread on the reclamation area. <br />Within parcel WP019, there is a scraper road that includes berms that must be knocked down, and there <br />may be a topsoil stockpile that needs to be spread on the reclamation area. It is unclear to Division staff <br />if this topsoil stockpile is indeed within parcel WP019; it appears to be on the edge of the parcel. We <br />ask that Colowyo Coal Company clarify this with your own survey. <br />Please remove the areas that contain these features from the maps in the bond release application. <br />Furthermore, the channels in the West Pit area (West Pit Fill Ditch and West Pit Coal Road Ditch) have <br />not been constructed, and it should be clear in the application that they are not included in the area to be <br />released. <br />Sincerely, <br />Robert D.
