Binns, Janet <br />From: <br />Binns, Janet <br />Sent: <br />Friday, June 17, 2011 11:23 AM <br />To: <br />Linda Saunders <br />Subject: <br />RE: Questions <br />Hello Linda, <br />I think if you read the letter informing you of Energy Fuels revision application you will find that; <br />"Energy Fuels Coal, Inc. proposes to relocate the Portal Area Reference Area to a site more representative of pre - <br />disturbance vegetation, soils and slope aspect. The proposed reference area would replace the currently approved <br />portal area reference area location (Reference plot "B "). The approved Refuse Area Reference Area would remain <br />unaffected by this proposal." <br />If you have the map, you will see that the approved portal area reference area is located on a fairly steep slope, in the <br />trees, with a north aspect. It was chosen at the time since it was one of the few undisturbed areas, and the operator did <br />not anticipate future disturbance on that location. It is questionable if it really represents the portal area that was <br />disturbed. <br />As to when we need to receive written comments; I mailed the letter on June 9th. Giving the USPS the benefit of the <br />doubt, and anticipating that you received the letter by June 12, 2011, the letter states, "we request that comments be <br />submitted within 15 days of this letter. If no comments are received by then, we will proceed on the assumption that <br />you have no concerns with, or objections to, the applicant's proposal." So, I am assuming the letter was delivered no <br />later than June 12th, please correct me if that is not the case. Please add 15 days to that date, which would be June 27tH <br />If you have concerns, please provide written comments to the Division by that date. The full application is available for <br />review at the Division offices in Denver, and at the Fremont County Clerk and Recorder's office in Canon City. <br />I will forward you a copy of the vegetation report. Without delving into the history of this mine further, I am unsure if <br />the reference area designation pre -dates Energy Fuels or not.
