April 22, 2013 <br />Mr. Tim Cazier <br />Colorado Division of Reclamation, Mining and Safety <br />1313 Sherman St. Room 215 <br />Denver, CO 80203 <br />RE: M- 2007 -014 Byzantine Quarry <br />Subject: Technical Revision (Seed Quantity Application) <br />Dear Mr. Cazier, <br />Byzantine Quarry LLC requests this Technical Revision to revise the seed application rate from the <br />previously approved reclamation plan that erroneously had the seed application rate at 100% PLS /AC for <br />all six grass species as opposed to the proper blend (please reference "Attachment C"). This resulted in <br />an application rate that was 600% of what is recommend for proper re- vegetation at the site. This <br />request will not modify the species of seed, only the rate of application, which will now match the <br />quantity per acre that is listed on "Attachment C" that has been provided by the U.S.D.A. Conservation <br />Service. <br />Because of this fact, the resulting reclamation budget was inadvertently inflated resulting in a surety <br />amount that is in excess of what is actually necessary for the proper reclamation activities that will be <br />required upon completion of mining activities.
