March 4, 2013
Very Truly Yours,
Kenneth S. Klco, Consulting Geologist
Azurite, Inc.
Azurite, Inc.
10001 CR 12 P.O. Box 338
Cotopaxi, Colorado 81223
719 - 942 -4178
Mr. Tim Cazier, Environmental Protection Specialist
Colorado Division of Reclamation, Mining, and Safety
1313 Sherman Street, Room 215
Denver, CO 80203
RECEIVED
MAR 11 2011
DIVISION OF -44 MING AND §4 f
RE: Permit # M- 1977 -193 Tezak Heavy Equipment Aggregate Source Granite Mine
/Request for Surety Release (Option 1) for permitted area along south boundary.
Per the Division's recommendation, Tezak Heavy Equipment Company elects to request
for a Surety Release for approximately four acres of former permitted mining land
located along the south boundary of the affected land. This parcel is the location of the
Tezak Heavy Equipment Company's truck shop for used for maintenance of their
highway fleet and heavy construction business and is not connected to the granite mine
operation located north of the truck shop area. Moreover, the southern gate and haul road
from the mining area to Tunnel Drive was removed from mine truck haulage a number of
years ago and is not used for granite product removal. Tezak Heavy Equipment
Company has developed a long term lease with the City of Canon City to use an
alternative route across City lands lying adjacent to and east of the affected land
boundary. In addition, T.H.E. and the City of Canon City have traded acreage and re-
aligned ownership boundaries along the east portion of the affected land area reflected in
the newly proposed affected land boundary shown on the current amendment application
map. This results in an overall increase in affected land acreage of approximately 4
acres, not including the major acreage increase of 79 acres of BLM lands lying west of
the current mining highwall area. All final reclamation and permanent erosion control
structures are in place and will not change in the future.
Please note that this acreage adjustment is reflected in the mine plan maps and acreages
submitted to the Division in application for amendment to M- 1977 -193 AM -05 currently
under consideration by the Division with the assumption that this acreage adjustment will
be approved as requested.
A mine plan map showing the former affected land boundary and the proposed new
affected land boundary is included with this mailing.
Please do not hesitate to contact me if you have any questions regarding this request.
Thank you.
