Our members and staff have an interest in the environmental health and <br />conditions of mined lands in Colorado and are directly and adversely affected by the Whirlwind <br />Mine, located near John Brown Canyon in western Mesa County. INFORM has longstanding <br />concerns about the Whirlwind's operations, its surface and related environmental conditions, and <br />the condition of ground and surface waters at the site. <br />According to the Notice of Temporary Cessation filed on Jan. 7, 2013, since the reclamation <br />permit was first issued for the Whirlwind Mine, only minor development and rehabilitative work <br />has occurred at the site and the underground workings have been allowed to fill with water since <br />late 2009. Since the permit was issued, the Whirlwind Mine has never entered active production <br />and has retained a status as an intermittent operation, even though it has not met the requirements <br />of the Colorado Mined Land Reclamation Act that require intermittent mines to operate and <br />produce every year. <br />Energy Fuels Resources asserts a date for commencement of temporary cessation dating to Sept. <br />19, 2012. However, the record demonstrates that the company was obligated under the Rules to <br />
