Pineda <br />Director <br />The Division has completed its review of Bowie Resources, LLC's (BRL) response to the Division's <br />December 21, 2012 adequacy review letter regarding the application for Technical Revision No. <br />76 for the Bowie No. 2 Mine. As a result of our review, we have the following comments: <br />Items 1 through 10 - Response adequate. <br />11. The Division required BRL to install a durable marker in the pond that clearly indicates the <br />5945' elevation in Pond F so that maintenance personnel can identify when the pond will <br />require pumping and /or sediment cleanout. BRL indicated that the marker would be <br />installed as soon as conditions allow. As discussed during the January 09, 2013 site <br />inspection, the Division requires that the marker be in place no later than June 15, 2013. <br />Items 12 through 14 -. Response adequate. <br />15. BRL indicated that the location of the West Diversion ditch has been modified so that flow <br />is routed through an existing channel. Should this existing channel show signs of <br />instability, BRL will need to design, obtain Division approval for, and implement <br />appropriate energy dissipation in the channel. <br />Items 16 through 18 - Response adequate. <br />During the adequacy review, BRL submitted additional information via electronic mail.
