Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) has reviewed McClane Canyon <br />Mining, LLC's PR -2 adequacy response letter received by the Division on October 18, 2012. <br />The Division has a few remaining adequacy concerns based on your responses to our comments. <br />Our comments are listed below and correspond to the original numbered paragraphs contained in <br />our initial adequacy review letter dated February 15, 2011. If the numbered paragraph is not <br />listed below than the item has been resolved. Please provide a response to the following <br />remaining comments and if appropriate provide revised application materials. <br />2. The Division has reviewed the new Appendix A information submitted by MCM and will <br />be conducting another AVS evaluation. If additional concerns are identified we will <br />inform MCM. No further response is necessary at this time. <br />3. A proposed decision on PR -2 by the Division is pending the completion of the <br />Environmental Assessment for the lease modification by the BLM and a Decision <br />Record. No further response from MCM is necessary at this time. <br />4. Consultation under Section 106 of the National Historic Preservation Act is still in <br />progress by the Federal agencies that are involved. The Division will inform MCM <br />when additional information is available. No further response from MCM is necessary <br />at this time. <br />11. Comments 11 through 14 pertain to alluvial and bedrock groundwater quality and <br />quantity, the hydrologic monitoring plan, and the need for groundwater points of <br />compliance. I would like to arrange a meeting with J.E. Stover & Associates/MCM in <br />the near future to expedite reconciliation of several concerns identified in our review of <br />the adequacy response submittal specific to groundwater information presented.
