RECEIVED <br />DEC 3 1 2012 <br />Division of Reclamation, <br />Mining & soggy <br />TO: Divison of Reclamation, Mining and Safety <br />Adams County Commissioners <br />RE: Reclamation of land by 120` Estate Partners .5 miles SE of Henderson, CO <br />DA: December 11, 2012 <br />To Whom it May Concern: <br />The West Adams Conservation District Board of Supervisors has reviewed the application of land by the 120` Estate <br />Partners .5 miles south of Henderson, CO, which is in our conservation district. <br />Thank you for the opportunity to comment on the above project. While we are happy to know 28 acres of land currently <br />out of agricultural use is proposed to be returned from gravel mining to agriculture, we have some serious concerns <br />about the future intentions for this land. <br />1. The primary future use and present use are both listed as General Agriculture, although the gravel pit is <br />currently lined with clay in anticipation of being used as water storage. If not crop, range or pastureland, what is <br />the specific intent? Will this land be 'dried up' and water rights sold from it, leaving it virtually unusable for <br />anything other than asphalt crushing and other activities of the kind? The application seems conflicting as it <br />states both 'general agriculture' and asphalt crushing facilities. We have serious reservations that agriculture <br />and asphalt are not compatible entities. <br />2. The application states that the site will be capped with clean dirt, seeded and restored to agricultural use. If the <br />land, again is not anticipated to be used as crop, range or pastureland, what type of seeding is proposed? We <br />request that the local NRCS experts be consulted as to what seeding is best for the specific site and that their <br />recommendations followed. <br />3. No plan to control weeds was submitted.
