ASPHALT <br />SPECIALTIES CO. <br />10100 Dallas St. • Henderson, CO 80640 • (303) 289 -8555 • Fax: (303) 289 -7707 <br />January 3, 2013 <br />Mr. Eric Scott <br />Environmental Protection Specialist <br />Colorado Div. of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: Request for 5 Extension of Time to Address Adequacy Review Comments for <br />Amendment (AM -2), Turnpike Mining Resource, DRMS Permit No. M -2004 -009 <br />Dear Mr. Scott: <br />Per an internal discussion with our consultant Peter Wayland on this project and per a <br />phone call with Tony Waldron of the DRMS on 12 -26 -12 regarding groundwater <br />sampling issues with the referenced amendment, I am officially requesting that Asphalt <br />Specialties Co., Inc (ASCI), the applicant for the referenced amendment, be granted <br />another extension of time for both ASCI and the DBMS to effectively address primarily <br />the groundwater sampling comments which we received the afternoon of December 10, <br />2012. We are requesting that we be granted an extension of approximately two weeks <br />from the previous requested decision date so that we will both have time to ensure that <br />the groundwater sampling issue is resolved. Given the "broken" nature of this year's <br />holiday season between Christmas and New Year's, we have only had time to contact <br />Tony to discuss the sampling situation and to prepare more data in that regard. We have <br />also pretty much completed any other adequacy comments with responses other than the <br />groundwater issue. I assume that the end of this extension request period will be <br />approximately January 22, 2013 based on the end of the previous decision date of <br />January 7, 2013.
