Hickenlooper
Governor
Mike King
Executive Director
Dick Wolfe, P.E.
Director /State Engineer
Dear Mr. Wayland:
This letter is in response to your letters dated June 2012 and August 2012 on behalf of
Coulson Excavating ( "Applicant ") requesting renewal of the above referenced substitute water
supply plan ( "SWSP ") for the Challenger Pit. The original plan was approved on June 30, 2005
and was most recently renewed on June 19, 2006. The required fee of $257 for the renewal of
this substitute water supply plan has been submitted (receipt no. 3655746).
Plan Operations and Depletions
Mining at the Challenger Pit site has been completed and the site was reclaimed in
2004 -2005. Reclamation activities created three unlined ponds with a total exposed surface
area of approximately 23 acres. Pond 1 measures 18 acres of water surface area, and Ponds 2
and 3 measure 3 and 2 acres respectively. All water surface area is exposed ground water and
there are no areas exposed due to mining activities prior to 1981. The only loss now associated
with the gravel pits and covered by this SWSP is evaporative loss. The previous substitute
water supply plan required the applicant to file for a permanent plan for augmentation with the
Water Court by December 31, 2006 to include, but not limited to, the long -term evaporation
losses. Such a plan has not been filed. You have stated that approval of this plan will assist in
proceeding to water court to obtain an augmentation plan as well as provide a working plan until
such time as the augmentation plan is approved by the Water Court. Failure to submit an
application to the Water Court for a permanent plan for augmentation may limit our abilities to
approve a renewal to this SWSP. Approval of this plan does not imply approval by this office of
any related litigation.
The anticipated net depletion for this plan is 52.62 acre -feet per year for up to 23 acres
of water exposed after December 31, 1980. Gross evaporation at this site is taken from NOAA
TR -33 Map 3 and is estimated to be 41 inches per year with an effective precipitation amount of
10.58 inches. The lagged evaporation depletions from the Challenger Pit were estimated by the
Applicant's consultant using the Integrated Decision Support group's Alluvial Water Accounting
Office of the State Engineer - bSL
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 - 866 -3581 • Fax: 303 - 866 -3589
www.water.state.co.us
