( "Applicant ") to cover depletions caused by <br />an existing gravel mining operation at the Speer Mining Resources Pit in accordance with § 37- <br />90- 137(11), C.R.S. The required fee of $257 for the renewal of this SWSP has been received <br />(receipt no. 3657233). The previous SWSP had an expiration date of December 31, 2012. As of <br />November 1, 2012 the City of Aurora is making releases for the plan based on the WY 2013 <br />renewed lease and thus this plan and thus this SWSP renews and supersedes the previous <br />SWSP. <br />Plan Operation <br />The site is no longer being mined for sand and gravel and final reclamation, consisting <br />backfilling the pit to eliminate exposed groundwater at the site is underway. Dewatering at the <br />site has ceased. Until the site is completely backfilled or a liner is in place and lagged <br />depletions have ceased, a substitute water supply plan is needed to replace depletions resulting <br />from the exposure of ground water to the atmosphere and operational losses. <br />In accordance with the letter dated April 30, 2010 from the Colorado Division of <br />Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators must comply <br />with the requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations <br />for the protection of water resources. The April 30, 2010 letter from DRMS required that you <br />provide information to DRMS to demonstrate you can replace long term injurious stream <br />depletions that result from mining related exposure of ground water. The DRMS letter identified <br />four approaches to satisfy this requirement. In accordance with approach nos. 1 and 3, a bond <br />has been obtained for $678,169 that can cover the cost of lining or backfilling the Speer Mining <br />Resources Pit to prevent the exposure of ground water. <br />
