It is stated in the preliminary design report that the Office of the State <br /> Engineer specifies an inflow design flood for Robinson Lake equal to 75 percent of the <br /> probable maximum flood. Rule 5.A. (5) (b) of the State Engineer's Rules and Regulations <br /> for Dam Safety and Dam Construction specifies an inflow design flood equal to 100 <br /> percent of the probable maximum flood for Class I dams. Has Climax received a <br /> dispensation for an existing structure? Please provide clarification. <br /> 2. The Division concurs with the statement in the preliminary design report that the <br /> new containment dike would not be a jurisdictional structure because it is within the <br /> existing impoundment, however, the new containment dike will be considered an <br /> environmental protection facility. As such, technical specifications, e.g. , gradation, <br /> moisture content, and density specifications, etc. for the embankment soils, as well as <br /> a construction quality assurance plan, e.g. , bentonite amended soil mixing and blending <br /> protocols, geotechnical testing types and frequencies, etc. , must be submitted for <br /> Division review prior to construction of the dike. <br /> If you have any questions, please contact me. <br /> Sinc rely, <br /> Pen' C.
