DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
Response to Reclamation Permit Amendment Application Consideration
DATE: December 5, 2012
TO: Berhan M. Keffelew, Environmental Protection Specialist
CC: Division 1 Office, District 2 Water Commissioner
FROM: Sarah Brucker, P.E.
RE: 120 Estate Partners, Permit No. M- 2001 -085
Operator: GSL /Brush LLC, (773) 548 -4131
Contact: Eric B. Fenster, (303) 921 -3530
Sec. 35, Twp. 1S, Rng. 67W, 6th P.M., Adams County
John W. Hickenlooper
Governor
Mike King
Executive Director
Dick Wolfe, P.E.
Director /State Engineer
COMMENTS: The amendment seeks to change the reclamation of the mined site from a clay -lined water
storage reservoir to backfilling the site to two feet above the historical water table. The site is proposed to be
filled and capped with clean dirt, reseeded, and restored to agricultural use. It is estimated that approximately
243,000 cubic yards of material will be used to fill the pit, which currently is approximately 28 acres in size.
Mining operations at the site have ceased; however, ongoing depletions are still occurring due to the exposure of
ground water at the site. The subject pit was included in a previous substitute water supply plan, valid through
October 31, 2012. The Applicant has submitted a request for renewal of said substitute water supply plan under
receipt no. 3657285. The request is pending approval until such time as the Applicant obtains and submits a
sufficient water lease.
The site must be covered under a valid substitute water supply plan until all depletions to the South Platte River
resulting from the current exposed water surface and past mining operations have been replaced. So long as
the Applicant complies with the terms and conditions of an approved substitute water supply plan, this office has
no objection to the proposed amendment.
The Applicant may contact the State Engineer's Office with any questions.
RECEIVED
DEC 05201
Division of Reclamat
Mining & Safety
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 - 866 -3581 • Fax: 303 - 866 -3589
www.water.state.co.us
