Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of the Varra <br />Companies, Inc. technical revision indicated above for the Western Sugar Reclamation Land <br />Development Project, File No. M- 2010 -049, and submits the following comments. The Division is <br />required to make an approval or denial decision no later than December 10, 2012 therefore; a <br />response to the following adequacy review concerns should be submitted to the Division as soon as <br />possible. <br />1. Rule 6.2.1(2) requires maps be signed by a registered land surveyor, professional engineer, or <br />other qualified person. The maps submitted to the Division were not signed. Please resubmit <br />signed copies of the maps. <br />2. The Division's engineering staff reviewed the October 8, 2012 Flood Analysis prepared by Flow <br />Technologies, LLC, and the November 9, 2012 riprap sizing analysis prepared by Varra <br />Companies. A copy of Mr. Cazier's memorandum is attached. Please address the comments <br />noted in the memorandum. <br />3. The Division will estimate the cost to repair flood damage during mining operations and install <br />the post mining flood control structures at the site based on the information submitted once <br />the Operator addresses the concerns noted in this letter. <br />4. Please commit to staying four hundred (400) feet from the tank battery in the northeast corner <br />of Tract C until the design for the hard armoring protection is submitted as a technical revision <br />and approved by the Division. <br />Please be advised the Western Sugar Reclamation Land Development Project technical revision no. <br />2 (TR -02) may be deemed inadequate, and the technical revision may be denied on December 10, <br />2012, unless the above mentioned adequacy review items are addressed to the satisfaction of the <br />Division. If more time is needed to complete the reply, the Division can grant an extension to the <br />Office of Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
