Pineda <br />Director <br />On November 23, 2011, the Division of Reclamation, Mining and Safety (Division) sent you a <br />Notice of Designated Mining Operation. On December 21, 2011, the Division received your <br />letter of concurrence and a request to extend the submittal date for the Environmental Protection <br />Plan (EPP) by 365 days from the date of the Division's notice. The Division approved the <br />extension request and extended the submittal date of the EPP to November 23, 2012. <br />To date, the Division has not received an EPP or a request to further extend the submittal date. <br />Based on these findings we believe that this is a violation of: <br />• C.R.S. 34- 32- 116.5(3)(a) &(b) for failure to submit an environmental protection plan <br />for approval by the office by the date established by rule. <br />Therefore, we have reason to believe that a violation exists to DRMS File Number M-1990--057 <br />and to the Law, and have scheduled this matter to appear before the Mined Land Reclamation <br />Board. <br />A Formal Public Hearing will be held during the January 9 and 10 2013 Board Meeting for <br />consideration of a possible violation. The hearing will be held in Room 318 of 1313 Sherman <br />Street, Denver, Colorado, beginning at 9:00 a.m. on January 9 or as soon thereafter as the <br />matter can be considered. At that hearing you will have the opportunity to be represented and <br />heard. It will be reiterated that there is reason to believe that you are in violation of the <br />provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist Order and/or assess <br />a Civil Penalty in the amount of $50.00 to $200.00 for each day of violation.
