November 27, 2012
RE:
Eric:
RECEIVED
NOV 2Q 2o12
DIVISION OF RECLAMATI ON
MINING AND SAFETy
Mr. Eric Scott, PG
Environmental Protection Specialist
Colorado Division of Reclamation, Mining and Safety (DRMS)
1313 Sherman Street, Room 215
Denver, CO 80203
).(,t, i.) /if 1
DRMS Permit M -1978 -327, Kauffman Pit #1, Larimer County Colorado
Technical Revision (TR) Request
RECEIVED
NOV 272012
Division of Reclamation,
Mining & Safety
Thank you for meeting with Frank and Mary Kauffman on site last month. The meeting was
held to review the current site condition and reclamation status of the Kauffmans' Pits as a
part of DRMS' annual inspection requirements.
In follow -up to that meeting, Jake Kauffman & Son, Inc. (JKS) as the Operator and Permit
Holder, hereby provide this request for a Technical Revision (TR) to their current DRMS
Permit for Kauffman #1 Pit, DRMS Permit # M- 1978 -327.
Specifically, this TR request is to address the following issues with regard to this Permit:
1. Acknowledgement via the attached, updated Exhibit F Reclamation Plan aerial map
that the Operator has completed backfilling a portion of the unlined groundwater -fed
lakes featured in the Permit. The backfilling has now passed the critical point where
the current exposed water surface area on site is less than the Operator is allowed to
have. The Operator has the right to expose unlined groundwater lakes to pre -1981
areas recognized by the Colorado Office of the State Engineer (SEO) for water rights
and augmentation purposes. The current exposed water surface area is 34.9 acres,
per aerial imagery from September 2012 used with the attached Exhibit F.
2. The attached Exhibit F Reclamation Plan, updated for this TR request submittal,
shows a corrected Permit Boundary. This Exhibit accurately represents the remaining
84.2 acres of the Permit property, in accordance with the June 12, 2006 DRMS
Acreage Reduction Approval. The Permit Exhibits used at that time and since have
inaccurately included the Big Thompson River, and areas south and immediately
north of the River, within the Permit Boundary. The Operator has not conducted
mining or related activities in the River nor other areas south of the indicated,
reconciled Permit Boundary shown. The Permit acreage has been correct at 84.2
acres since the 2006 Acreage Reduction, and the corrected Permit Boundary now
reflects and includes the intended 84.2 acres, as well. The correction involved
revising the south line of the southeast "panhandle" portion of the Permit.
A: 4220 Golf Vista Drive, Loveland, Colorado 80537 0 P: 303.929.3194 0 E: dangiroux @dcs- cm.com
DCS Project 12 -220 © Copyright 2012, DCS, Inc.
