Taft hill Road <br />Fort Collins, CO 80521 <br />Re: Duckworth Pit, Permit No. M- 2003 -091, Slurry Wall Financial Warranty Increase, Revision <br />No. SI-02 <br />Dear Mrs. Mikulas: <br />On November 19, 2012, the Division of Reclamation, Mining and Safety increased the current <br />Financial Warranty for this permit to $1,603,000.00, in accordance with Rule 4.2.1 of the Rules and <br />Regulations. This is an increase of $987,000.00. The warranty was increased to include the cost <br />for slurry wall installation for exposed groundwater compliance. A copy of the calculation used to <br />determine the financial warranty increase is attached for your review. <br />Martin Marietta will have 60 -days (January 18, 2013) from the date of this letter to submit a <br />rider or a new financial warranty per Rule 4.2. If you wish to submit a different type of Financial <br />Warranty, the various application forms can be found at the following website: <br />http: / /mining. state .co.us /Mineral %20Forms.htm.
