Dear Mr. Perino:
The following is a list of concerns regarding the proposal to
install bulkhead seals within the Sunnyside Mine as detailed in
vc,iir technical revision submittal received by the Division of
Minerals and Geoloay_ (Division) on March 30, 1993 . Please respond
to each item prior to tic tAipril 30, 1993 decision date set for
technical revision no. 14 .
1 Continuing Discharge After Bulkhead Placement
Currently Sunnyside Gold is required to treat all water flowing
f —_ }uc Tun.nc tc standards set by the Co- nr?r7n
Department of Health (CDOH) prior to discharge into Cement Creek.
The proposed American Tunnel bulkhead is designed to eliminate, or
nearly eliminate, that portion of the discharge that originates
from Sunnyside Gold Property. Figure 10 of the Febr;:arZ 1; 1992
Simon Hvdro Search report submitted in support of this technical
revision indicates that placement u£ a bulkhead 7950 feet iiiuy of
the aortal will eliminate approximately 25 percent of the discharge
from the American Tunnel. The assignation of responsibility for
impacts to the hydrologic balance caused by the continued discharge
after bulkhead placement, will have a pivotal impact on continuing
reclamation at the site.
C.R.S. 34-32-116 (7) (g) requires that disturbance to the prevailing
hydrologic balance caused by mining operations be minimized. It is
the policy of the Mined Lana Reclamation Board (Board) and the
Division that minimization of disturbance include ensuring
compliance with existing local, state and federal regulations.
Paramount among the existing water related regulations are the
Colorado and federal clean water acts. It would follow that if
CDOH approves Sunnyside Gold ' s request to relocate the American
Tunnel discharge point from the portal area to the downstream side
of the bulkhead, that a determination will have been made by CDOH
that continued flow from the American Tunnel represents a pre-
