Therefore, exposure of ground <br />water must not occur during or after mining operations. <br />The applicant has not identified any proposed use of water at the permit site. If water will be used for <br />any purpose at this site, the applicant will need to document that the water was obtained from a legal <br />source, or the water was diverted in priority under a water right decreed for such industrial use. <br />COMMENTS: The application seeks to convert M- 2004 -030 from a 110(c) Limited Impact Construction Materials <br />Permit to a 112(c) Regular Construction Materials Permit. The application also seeks to add 15.1 acres to the <br />current 9.9 permitted acres, for a total permit area of 25 acres. The primary commodity to be mined is flagstone. <br />The site is proposed to be reclaimed to rangeland upon completion of mining activities. <br />If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must be released <br />to the stream system within 72 hours, which may require a discharge permit from CDPHE -WQCD.
