In the letter you requested a determination on whether a <br /> the trench was a point source and needed a CDPS permit. In making a determination, I did <br /> review past information relative to Lake Emma. <br /> For a source to require a permit it must be a point source discharge of pollutants into state <br /> waters. It is clear that the discharge will indeed be to state waters, as it will discharge into the <br /> old outlet of Lake Emma. According to the information supplied to the Division, the diversion <br /> trench will be either an open ditch or pipe and should be approximately 2500 gpm. Either the <br /> trench or the pipe can be considered a point source. The final determination is whether the <br /> discharge will contain pollutants. This is more difficult to determine. The Division has <br /> routinely not required permits for diversion of groundwater, such as a sump pump when it has <br /> been show not to be contaminated and is moving to the same water body it would naturally flow. <br /> If this trench is constructed in an undisturbed area and diverts unaffected waters it would not <br /> require a permit since there would be no discharge of added "pollutants". It is unclear from the <br /> information I received if the ditch is being constructed in an undisturbed area or constructed <br /> through mine waste. Additionally, if stormwater runoff from tailings left in the area finds its <br /> way into the ditch, the discharge point would then need to be covered under the stormwater <br /> program and would need a permit until the area is reclaimed and released from bond. <br />
