Inadequate Request for Transfer of Mineral Permit and Succession of Operators Application Packet
Dear Mr. Griffin:
On August 9, 2012, the Division of Reclamation, Mining and Safety received an incomplete Application Form for Transfer
of Mineral Permit and Succession of Operators for Jemadojin Sand Mine, Permit M- 2006 -017. Although you explained that
the Oglebay Norton Industrial Sand, Inc has changed its name to Premier Silica LLC due to a stock purchase agreement by
Pioneer Natural Resources Pumping Services LLC, this will involve the transfer of the mineral permit M- 2006 -017 to the
new name by a Succession of Operator process. Please complete and return the following items of the application packet:
1. Page 5, 6, 7 of the application; Administrative Information, Designation of Review Timeline, Due
Diligence Certification.
2. Performance Warranty by new entity.
3. Financial Warranty by new entity. If maintaining current corporate surety bond, this may be done by a Rider from
the insurance carrier.
4. Legal Authority to Execute Financial Warranty Documents.
5. Demonstration of Legal Right to Enter not provided.
6. Structure Agreement not provided or noted not required.
I have included The Division's Filing Requirements for the SO Application for your reference. The missing information
should be mailed to: State of Colorado, Division of Reclamation Mining and Safety, 1313 Sherman Street, Room 215,
Denver, CO 80203. Processing of your application will not begin until a completed application packet is received.
