MANAGEMENT <br />On behalf of New Elk Coal Company (NECC), the following responses have been prepared in reply to the <br />Division of Reclamation, Mining and Safety (DRMS)' comments and concerns regarding the above - <br />referenced technical revision, stated in the letter dated July 18, 2012 . <br />1. Based on NECC's TR -17 submittal, Lorencito Coal, LLC no longer leases water rights. However <br />approved page 2.04 -32 discusses the alternative water supply information. Please revise page <br />2.04 -32 to proved a statement that LLC no longer leases water rights if that is still the case. <br />NECC - Page 2.04 -32 was amended as requested. <br />2. NECC's response to the Division notes the 2009 Annual Reclamation Report states that a shrub <br />transplant area was selected in area C -1. However, approved Figure 2.05.4 -19A delineates a <br />location of proposed shrub transplant that differs from C -1. Please provide an update to the <br />above mentioned Figure or a revision to the mentioned location of the actual shrub transplant <br />area. <br />Sincerely, <br />NECC - Figure 2.05.4 -19A was deleted from the permit by TR -16. Table of contents page ix, <br />revised by TR -16, confirms this deletion. An amended Map 2.05.3 -5 was incorporated into the <br />permit by TR -16. Amended Map 2.05.3 -5 shows the outline of the shrub transplant plot located <br />in area C -1. Page 2.05 -66b was revised to state the shrub plot was placed in area C -1 where <br />shown on Map 2.05.3 -5.
