Hays <br />Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 ,/ ,� <br />Re: Permit M -1992 -069 — 83 Joint Venture Pit — Technical Revision TR -08 <br />Dear Peter: <br />Per the Division of Reclamation, Mining and Safety (DRMS) June 18, 2012 approval of the above - <br />referenced technical revision, an incremental increase to the financial warranty for backfilling the site by <br />August 17, 2012 is required. Subsequent to DRMS approval of the revision request, which was submitted <br />per DRMS requirements to bring the site into compliance with regard to groundwater exposure, <br />Aggregate Industries (AI) discussed with Dick Wolfe, State Engineer with the Division of Water <br />Resources (DWR), the various issues associated with this site that need to be resolved before Al could <br />actually proceed with any backfill activity. <br />In response to that discussion, Mr. Wolfe indicated that, as long as AI maintains the site under its <br />temporary substitute supply plan to mitigate stream depletions associated with the site's exposed ground <br />water, a temporary variance of compliance with requirements relative to long -term exposed groundwater <br />at this site would be approved until such time as the various issues can be sorted out and resolved. Al <br />submitted a formal, written variance request to Mr. Wolfe on July 27, 2012, and asked that he provide <br />written confirmation of approval. A copy of AI's letter request is enclosed for your reference. <br />Based upon DWR's variance approval, Al requests withdrawal of the DRMS technical revision to backfill <br />the site or that bonding for an increase in financial warranty be waived consistent with the DWR variance <br />approval, which is currently for the term of AI's temporary substitute supply plan through December 31, <br />2013.
