DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
A R
John W. Hickenlooper
Governor
Mike King
Executive Director
Dick Wolfe, P.E.
Director /State Engineer
Response to Reclamation Permit Partial Acreage Release Request Consideration
DATE: August 8, 2012
TO: teeter S. Hays, Environmental Protection Specialist
CC. Division 1 Office, District 3 Water Commissioner
FROM: Sarah Brucker, P.E.
E 8 Street Operation, File No. All -2000 -082
Operator: Aggregate Industries — WCR, Inc.
Contact: Connie N. Davis, (970) 396 -5252
Sec. 4, Twp. 5 North, Rng. 65 West, 6th P.M., Weld County
COMMENTS: The applicant has requested a partial acreage release for the East 8 Street Pit. The release is
for two parcels of 17.36 acres and 3.79 acres within the current 69.9 -acre mining permit boundary. Based on
2011 aerial photography, there are approximately 5 acres of exposed water surface located within the 17.36 -
acre parcel. There also appears to be a small (0.15 -acre) pond within the 3.79 -acre parcel. The request for
acreage release did not specify how evaporative losses from these ponds will be addressed. It appears that the
larger pond may have a plastic liner; however this office does not have any liner approvals on file for this site.
The East 8 Street Pit is currently included in the Aggregate Industries South Platte Combined substitute water
supply plan, valid through December 31, 2012. If the subject areas are removed from the mining permit
boundary, it is unclear who will be responsible for making replacements for any exposed water area or how
those replacements will be made after the current SWSP expires. Therefore, we object to the partial acreage
release until the surface water evaporation issue is clarified and sufficient replacement is provided as
necessary.
RECEfV
UG 0 8 2
Division Of i.eciarnal :.:
Mining & Safe: v
Office of the State Enginee i 0 S L'
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 - 866 -3581 • Fax: 303 - 866 -3589
www.water.state.co.us
