Scott, Environmental Protection Specialist / <br />CC: Division 1 Office, District 6 Water Commissioner 3 1 2012 <br />FROM: Sarah Brucker, P.E.rI ; ',> <br />RE: Turnpike Mining Resource, File No. M8004 -009 <br />Operator: Asphalt Specialties Co., Inc., (303) 289 -8555 <br />Sec. 31, Twp. 2 North, Rng. 68 West, 6th P.M., Weld County <br />CONDITIONS FOR APPROVAL <br />• The proposed operation will still consume ground water by: ® evaporation, ® dust control, ❑ <br />reclamation, ® water removed in the mined product, ❑ processing, ® other: dewatering. <br />Well permit no. 64830 -F was issued on September 13, 2006 for the above uses pursuant to a substitute <br />water supply plan, which was valid through July 31, 2008. A request for renewal of the substitute water <br />supply plan was submitted to this office on March 9, 2011. The site appears to have been operated in <br />accordance with the 2011 renewal request. The applicant's engineer has informed us a revised SWSP <br />request that incorporates this amendment will be submitted following the DRMS amendment approval. <br />• The proposed operation may have potential impact on existing water rights near the project location. <br />Applicant needs to demonstrate that the proposed project will not alter or impact the historic operation of <br />existing water rights. <br />COMMENTS: The applicant has requested an amendment to incorporate excess reservoir construction by- <br />product (shale) into the site reclamation plan. The requested amendment will have no effect on water use at the <br />site or the impact of mining operations on water rights.
