Berry, David
From: Chris Kamper [CKamper @cksmb.com]
Sent: Friday, May 04, 2012 2:20 PM
To: Berry, David
Cc: Jeff Fugate
Subject: RE: Phone call from Jim Guire
David, thanks.
It would be helpful to have a complete complaint or statement to respond to, rather than trying to anticipate Guire's
arguments. I would be surprised if a title company actually told him what he says below, because title companies as you
may know usually won't touch mining leases with a 10 -foot pole.
Either way, appreciate the heads up and have a good weekend.
Chris
From: Berry, David [mailto:David.Berry@state.co.us]
Sent: Friday, May 04, 2012 2:13 PM
To: Chris Kamper
Cc: Jeff Fugate
Subject: FW: Phone call from Jim Guire
WR
14- e5(
;
Hello Chris — Please see the below message regarding ongoing input from Mr. Guire.
I intend to contact Mr. Guire and ask that he send us a letter specifically defining the nature and basis of his complaint. I
will also request a letter of response to DRMS from WFC once we receive the Guire letter.
Right of entry is a compliance requirement. However, DRMS will not attempt to "adjudicate" the issue of property rights
if we receive conflicting, but seemingly valid information regarding the right of entry situation. I will work closely with
Jeff (AGO) to assess the validity of the potentially conflicting positions, and to assess any DRMS position or necessary
actions as this issue progresses.
I will also be in contact with OSM to advise of the ongoing situation, and I will request that OSM does not issue any TDN
(s) given our ongoing involvement. I may or may not be successful in that request.
Any help in resolving the situation directly with Guire will be most appreciated.
Thank you,
David
From: Brown, Sandy
Sent: Thursday, May 03, 2012 1:28 PM
To: Berry, David
Cc: 'Jeff Fugate'
Subject: Phone call from Jim Guire
Jim Guire called again this morning at 11:06 am. He recently met with Lance Wade about the lease situation. WFC
contends that they have a valid lease for the property he purchased from San Miguel Power Co.
1
