RECEIVED
Sfk r 1 JUL 19 2012
July 17, 2012 Division of Reclamation,
Mining&Safety
AN
Mr. Tom Kaldenbach AGGREGATE
Division of Reclamation, Mining and Safety
1300 Sherman Street, Room 201 INDUSTRIES
Denver, CO
Re: M-2000-082 - East 8th Street Operation—Acreage Reduction Request
Dear Tom:
Aggregate Industries-WCR, Inc. (AI) submits this letter as a request for an acreage
reduction of approximately 21.15 acres from the above-referenced permit. This reduction
request is based upon a partial termination of AI's mining lease with property owners
GURA and Leprino Foods Company(Leprino) and terms of AI's lease agreement for the
remaining acreage with property owner Greeley Urban Renewal Authority(GURA).
The current permit area of the East 8th Street Operation contains approximately 69.9 acres
of land and is located within the City of Greeley. City of Greeley approved a minor
subdivision for the property and re-zoned a portion of the property in September, 2010.
Per Meyer Minor Subdivision final plat recorded December 20, 2010 at Reception No.
3739916 in the office of the Weld County Clerk and Recorder(copy enclosed),
approximately 17.36 acres of the permit area was rezoned from C-D (Conservation
District), which allows sand and gravel mining as a Use by Special Review, to I-M
(Industrial Medium Intensity), which does not allow sand and gravel mining. The
subdivision and re-zoning were approved to accommodate Leprino's purchase from
GURA and development of approximately 12.79 acres (Lot 1 and Outlot A as depicted
on the Meyer Minor Subdivision Plat), for its cheese and whey factory.
Leprino purchased from GURA the 12.79 acre parcels in December, 2010 subject to the
mining lease between GURA and AI. In conjunction with Leprino's purchase, Leprino,
GURA and AI executed a Partial Termination of Mining Lease (Termination),
terminating AI's right to mine Lot 1 and Outlot A and Lot 2 and Outlot B of the Meyer
Minor Subdivision, subject to AI's continued right to make use of an existing access from
Ash Avenue across the Leprino property. A copy of the Termination is enclosed. In
accordance with the Termination, GURA relocated and seeded stockpiles from parcels
terminated from the lease to the northwest corner of the Phase III mine area and AI has
Aggregate Industries
West Central Region, Inc.
1707 Cole Blvd., Suite 100
Golden, CO 80401
Telephone:303-985-1070 An Equal Opportunity Employer
