Box 191 <br />Victor, CO 80860 <br />Re: Cresson Project; DRMS File No. M- 1980 -244; <br />Technical Revision (TR -65) Adequacy Review <br />Dear Mr. Comer: <br />STATE OF COLORADO <br />4) Drawings A501 and A502 — Related to Item 2 above, Drawing A502, Detail 2 does not show the <br />placement of CFDM, nor does Drawing A501 appear to show the finish grade elevations of the <br />CFDM. The intent of the Phase 5 Berm Raise Design is to ensure a potential future spill similar to <br />the event that occurred the week of April 13, 2012. Hickenlooper <br />Govemor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) has reviewed your June 25, 2012 request for a <br />technical revision (TR -65), Specification Change in Overburden Fill Testing Frequency and VLF Phase 5 <br />Berm Raise Design. The submittal was called complete for the purpose of filing on June 28, 2012. The <br />decision date for TR -65 is July 30, 2012. Please be advised that if you are unable to satisfactorily address any <br />concerns identified in this review before the decision date, it will be your responsibility to request an <br />extension of the review period. If there are outstanding issues that have not been adequately addressed prior <br />to the end of the review period, and no extension has been requested, the Division will deny this application. <br />The following comments are based on the Division's review of the June 25, 2012 Request for Technical <br />Revision TR -65 and the three drawings submitted with it: <br />1) Page 1, Specification Change — Based on discussions between CC &V and the Division while the <br />request for TR -65 was in the mail, the Division will not consider the proposed revised Specification <br />Change for Overburden Fill Testing Frequency. <br />2) Third Page/Drawing A502 — The first paragraph states Coarse Free Draining Material (CFDM) will <br />be installed for additional storage capacity and DCF will be placed or maintained beneath the <br />CFDM. Neither the text nor Drawing A502 present information on how thick a layer of DCF will be <br />placed or maintained under the CFDM. The Division is concerned about maintaining the integrity of <br />the liner during construction and placement of the CFDM. Please specify how much DCF will be <br />used to protect the liner. <br />3) Third Page — The paragraph states DCF will not be placed over the newly installed sections of liner. <br />Please clarify if the intent is to leave portions of the liner exposed. If this is the case, the liner will <br />need to be periodically inspected to ensure it is not damaged during normal mine operations and <br />maintenance. <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
