The DRMS' letter dated October 22, 2011, transmitted its adequacy review for Bowie
No. 2 Mine's permit renewal no. 3. It is uncertain when the permit renewal application
will be approved. Therefore, the pages, maps and exhibits revised for the permit
renewal will be incorporated into the permit by this minor revision. The responses to the
DMRS' comments and concerns regarding the permit renewal follow.
1. DRMS - Please update the identification of interests information that is required in Sections
2.03.4(1) through (10) of the permit application, where applicable. The updates should include,
but not be limited to, ownership and control information that is required in Section 2.03.4(3) and
(4), the list of the owners of record of surface areas to be affected and the list of owners of record
of the coal to be mined, as required in Section 2.03.4(6), and the list of the owners of record of
the surface and subsurface areas that are contiguous to the permit area that is required in
Section 2.03.4(7).
Bowie - There has been no change to the ownership and control information that
is required in Section 2.03.4(3) and (4) or the owners of record of the coal to be
mined. The owners of record of the surface areas contiguous to the permit area
were updated on pages 2.03 -5, 6 & 7.
2. DRMS - Please update Section 2.03.5, Compliance Information, if applicable.
Bowie - Pages 2.03 -10 & 11 were amended to update the compliance
information.
3. DRMS - If applicable, please update the list of other licenses and permits in Section 2.03.10.
Bowie - Page 2.03 -19 was updated.
4. DRMS - Please update the discussion on water rights in Section 2.04.7, if applicable.
