Box 670 <br />Hayden CO 81639 <br />RE: Seneca I1W Mine (Permit No. C1982057) <br />Technical Revision No. 73 — Pond 016 Slide Remediation <br />Request to Postpone Topsoiling and Seeding <br />Dear Mr. Karo: <br />The Division has received your request for postponement of topsoil redistribution and seeding of areas of <br />the Seneca I1W Mine affected by the slide remediation work. We agree that the past winter was extremely <br />dry and was not likely a good test of whether the remediation efforts in the Pond 016 slide area were <br />successful. In order to ensure that topsoil resources would not be lost should a subsequent slide occur, it <br />would be best to verify the stability of the area under normal conditions before topsoil is replaced. <br />Therefore, the Division approves your request to delay topsoil replacement and seeding until 2013. Topsoil <br />replacement and seeding must be completed no later than December 31, 2013. In the interim, it is <br />imperative that Seneca Coal Company continue to control noxious weeds on the topsoil stockpile and <br />regraded areas even though final reclamation of the areas will be delayed. <br />The 2011 Rill and Gully Map submitted by Seneca Coal Company indicates that the Pond 016 area drainage <br />and road would be topsoiled.
