Mr. Renner' s letter was in response <br /> to your concern regarding Mid-Continent' s bond and an OSM Ten Day Notice which <br /> was prompted by your letter. <br /> As Mr. Renner related, the Board Order which allowed Mid-Continent to pursue <br /> sale of the operation contains provisions which preclude us from requiring <br /> additional reclamation bond at this time. The Board Order also insures that <br /> we will be able to pursue permit revocation and bond forfeiture without delay <br /> if Mid-Continent cannot make specific demonstrations of their capability to <br /> initiate reclamation in compliance with the specified schedule. Mid-Continent <br /> is required to provide such demonstrations to us by January 15, 1992 <br /> if the mine is not sold, with the matter to be heard by the Board on <br /> January 22, 1992. If we do forfeit the bond, and are unable to secure the <br /> necessary funds , we will pursue legal remedies. <br /> Due to the nature of your concern, it was our determination that a mine <br /> inspection was not warranted, indeed you did not request an inspection. You <br /> did, however, request that we take an enforcement action. For the reasons <br /> outlined above, we have not taken an enforcement action at this time. If you <br /> choose, you have the right to request in writing that the Division Director <br /> informally review the decision to not take an enforcement action. <br /> Please contact me if you have any questions. <br /> SinceL�t <br /> Dan T.
