This letter also serves as the Office of Surface Mining's (OSM) final response on <br /> this matter. <br /> OSM sent a letter to the complainant dated April 28, 1998, which served as GSM's initial <br /> response to this complaint. In summary, the response found that it was not necessary for OSM to <br /> perform an independent estimate of the cost of completing full reclamation at the Coal Basin <br /> Mine, nor to independently file suit against Mid-Continent Resources and its' officers and agents <br /> as the complaint suggested. OSM also found DMG had provided accurate and appropriate <br /> documentation of administrative, enforcement, and civil actions brought to date by DMG against <br /> Mid-Continent Resources and it's agents; accurately documented reclamation history and <br /> ongoing reclamation activity at Coal Basin; and accurately characterized a Colorado Court of <br /> Appeals ruling. DMG's correspondence to OSM states "The Court of Appeals' ruling left open <br /> the possibility of the Division(DMG)pursuing funds against the Agents of MCR should funds <br /> through the liquidation plan prove insufficient to conduct necessary reclamation." GSM's April <br /> 28 initial response letter is hereby incorporated by reference. <br /> DMG's June 8 response to OSM noted above provides descriptions and documentation <br /> addressing concerns as expressed by the complainant in his March 24, 1998, letter to OSM. The <br /> complainant's March 24 letter was forwarded to DMG as supplemental concerns to be addressed <br /> under TDN 98-140-116-001. The March 24 letter states " Re: CITIZEN COMPLAINT <br /> ALLEGING IMPROPER ASSUMPTION BY THE COLORADO DIVISION OF MINERALS <br /> AND GEOLOGY OF COSTS OF RECLAIMING MID-CONTINENT RESOURCES COAL <br /> BASIN MINES TO THE DETRIMENT OF THE PUBLIC INTEREST AND IN VIOLATION <br /> OF THE LAW. " <br />
