06/05/2012 18:51 FAX 19708823030 974 - 664 -2118 [a 001/003 <br />June 05, 2012 <br />Ms. Marcia Talvitie <br />Department of Natural Resources <br />Division of Reclamation, Mining and Safety <br />1313 Sherman St., Room 215 <br />Denver, CO 50203 Sent Via Fax to: 303 -832 -5106 <br />RE: Complaint against Western Fuels — Colorado, LLC Permit No. C- 1981 -008 <br />Dear Ms. Talvitie, <br />I became aware of a "Public Notice" in the May 31, 2012 Sane Miguel Basin forum publication, <br />whereas Western Fuels has applied for Phase 1 & III bond release on portions of BB Road and <br />27.00 Road as well as the Benson and Lloyd (WFC — Current Owner) property located NW of BB <br />and 27.00 Rd. <br />In researching information on the DMRS Laserfiche Weblink, I found the entry submitted to <br />DRMS by Greg Lewieki and Associates and scanned in on 05/10/2012 9:45;33 AM containing 31 <br />pages. <br />After Page 11 "Appendix A" — Notification Letters page, I noticed on page 19 and 19 a letter <br />dated 4 May 2012 from Western Fuels — Colorado, LLC to 4/7, LLC. <br />We have not received any such letter from Western Fuels. I contacted Frank and Marylou <br />Morgan as well as Patty Morgan and Bud and Teresa Henson and found that we were not the only <br />ones who did not receive letters that were addressed to any of us as stated in the "Bond Release <br />Request" of May 2012. <br />Also, please correct us if we are wrong, but in the preamble of the Public Notice as well as the <br />Bond Release Request, it states that "The permit number is C -81 -008, which was issued on May <br />26, 1983 ". please see attached copy of letter dated May 15, 1993 to Western Fuels — Colorado <br />from Mr. Harry B. Ranney of DMRS as well as a copy of the front page of Western fuels <br />Colorado's actual mining permit that states "Permit Date: May 26, 1993 ". <br />If you wouldn't mind enlightening us as to the two issues above. <br />Also of concern to us is a section of BB Road along the northern boundary of our land that has <br />settled. Should 'Western Fuels — Colorado be held responsible for this settlement prior to any <br />final bond release? <br />Thank you for your time and consideration! <br />Sincerely, <br />im R.
