Box 177 <br /> Silverton, CO 81433 <br /> RE: American Tunnel and Terry Tunnel Hydraulic Seals, Technical <br /> Revision TR-14, File No. M-7J-378 <br /> Dear Mr. Perino: ✓ <br /> The following is a list of concerns regarding the proposal to <br /> install bulkhead seals within the SUnnyside Mine as detailed in <br /> your technical revision submittal received by the Division of <br /> Minerals and Geology (Division) on March 30, 1993. Please respond <br /> to each item prior to the April 30, 1993 decision date set for <br /> technical revision no. 14. <br /> 1 Continuing Discharge After Bulkhead Placement <br /> Currently Sunnyside Gold is required to treat all water flowing <br /> from the American Tunnel to standards set by the Colorado <br /> Department of Health (CDOH) prior to discharge into Cement Creek. <br /> The proposed American Tunnel bulkhead is designed to eliminate, or <br /> nearly eliminate, that portion of the discharge that originates <br /> from Sunnyside Gold Property. Figure 10 of the February 11, 1992 <br /> Simon Hydro Search report submitted in support of this technical <br /> revision indicates that placement of a bulkhead 7950 feet inby of <br /> the portal will eliminate approximately 25 percent of the discharge <br /> from the American Tunnel. The assignation of responsibility for <br /> impacts to the hydrologic balance caused by the continued discharge <br /> after bulkhead placement, will have a pivotal impact on continuing <br /> reclamation at the site. <br /> C.R.S. 34-32-116(7) (g) requires that disturbance to the prevailing <br /> hydrologic balance caused by mining operations be minimized. It is <br /> the policy of the Mined Land Reclamation Board (Board) and the <br /> Division that minimization of disturbance include ensuring <br /> compliance with existing local, state and federal regulations. <br /> Paramount among the existing water related regulations are the <br /> Colorado and federal clean water acts. It would follow that if <br /> CDOH approves Sunnyside Gold's request to relocate the American <br /> Tunnel discharge point from the portal area to the downstream side <br /> of the bulkhead, that a determination will have been made by CDOH <br /> that continued flow from the American Tunnel represents a pre- <br />
