The applicant shall be <br />responsible for compliance with this plan, but the State Engineer's Office may also pursue the <br />landowner for eventual compliance. The required fee of $257 (receipt number 3653339) for the <br />substitute water supply plan has been paid. <br />Plan of Operation <br />s mk <br />DEPARTMENT OF NATURAL RESOURCES 44 — 193 <br />\\ DIVISION OF WATER RESOURCES <br />May 21, 2012 <br />Office of the State Engineer <br />RECEIVED <br />41AY 222012 <br />Division of Reclamation, <br />Mining & Safety <br />NAY 22.2012 <br />Pond #1 is an unlined depression which was originally created during sand and gravel <br />mining operations between 1980 and 1982 under Pioneer's Permit Number M1977 -174 (Vollmer <br />Road Pit) and is located northeast of Colorado Springs in the SE1 /4 of the NE1 /4 of Section 5, <br />Township 13 South, Range 65 West of the 6 P.M. in El Paso County. Currently the pond <br />exposes 1.07 acres of groundwater and only half of the pond lies within the Monks 35 -acre <br />property. The other half of the pond extends onto the 132 acre parcel owned by Pioneer. Water <br />is piped from this pond to a nearby concrete batch plant which is leased and operated by <br />Lafarge. Although the water surface is partially located on an adjacent property, the Applicant <br />will provide replacements for all depletions attributable to Pond #1. <br />RECEIVED <br />In accordance with the letter dated April 30, 2010 (copy attached) from the <br />Colorado Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel <br />mining operators must comply with the requirements of the Colorado Reclamation Act <br />and the Mineral Rules and Regulations for the protection of water resources.
