Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division has received your application for renewal of the Colowyo Coal Company (CCC) <br />mining permit. The application was received by the Division of Reclamation, Mining and Safety <br />(Division) on March 12, 2012. Thank you for your timely submittal of the renewal application. <br />Pursuant to Rule 2.08.5(3)(f) an application for renewal must be received by the Division no <br />later than 180 days prior to permit expiration in order for the operator to maintain the right of <br />successive renewal. Colowyo's permit expires on November 5, 2012. Based on the expiration <br />date, the Division must have received Colowyo's application no later than May 9, 2012. Since <br />the Division received the application for renewal prior to this date, CCC retains the right of <br />successive renewal for Coal Mining Permit Number C- 1981 -019. <br />Based on the Division's review of the materials submitted with the application for RN -06 and <br />based on a review of the approved Permit, the Division has the following adequacy comments <br />and questions. <br />1. Stipulations <br />a. Currently Colowyo has five outstanding stipulations. Four of these are related to potential <br />development of the Lower Wilson Area and are not an issue at this time. No response is <br />required from CCC. <br />b. The remaining stipulation, Stipulation 7, relates to a groundwater point of compliance.
