We will be proceeding on this amendment in the near future. The Division is,however, still
concerned about the maintenance of the sediment ponds_ In order to reduce the required water quality monitoring of
the site as you requested,we need to be assured that the water quality control structures ale properly operated and
maintained. We do not wish to have the ponds fill with sediment and discharge in violation of permit requirements.
As we have stated previously,we feel that Mid-Continent Resources is responsible for compliance with the permit.
As a result of these concerns, the Division is requesting that you inform us in writing«within 20 days of receipt of
this letter, the measures you will take to prevent violations from occurring. If such measures do not include the
cleaning of the ponds, please explain why it is not needed- In addition, please include a schedule for the
implementation of the measures you propose.
Please contact me with any questions.
Sincerely,
a 41r'o
Patricia A.Nelson,P.E.
Industrial Program Chief
Permits and Enforcement Section
WATER QUALITY CONTROL DIVISION
cc- Dwain Watson,Held Support Section,WQCD
Amelia Whiting,Attomcy General's OLGce
Steve Renner,Division of Mncrals and Otology
Cheryl Linden,Attomey General's Office
Loeal Hcalth Dcpartinent
MS-3 Permit File
