DMG(97CV131-3) Pitlan County District Court <br /> Dear Ed: <br /> I have rnviewed your draft order the trial schedule in this case pursuant to <br /> the heating held on March 3, 1998. I have a few suggestions. Regarding the pretrial motions,I <br /> think it would better to set a date for filing that'would allow the court to have a chance to rule an <br /> the motion prior to trial. The judge mentioned at the hearing that he aright not have an <br /> opportunity to rule on any motion if it is filed within the applicable rules. Therefore,I would <br /> suggest setting a deadline,sometime in mid-July,for filing pretrial XnOdons. This would allow <br /> responsive pleadings to be filed and give the court a chance to rule on the motion prior to finial. <br /> Also,I think this deadline would apply not only to motions under C_R.C.P. 12,but also to other <br /> motions including motions in iimine. <br /> on page 3,concerning'Trial Briefs,I suggest that we add in a sentence that counsel will <br /> inform opposing counsel by July 20, 199S,whether counsel will be filing a trial brief and <br /> specifying the pm-doular claims or issues covered by the brief. In addition,under Rule 161 think <br /> the appropriate date for filing trial briefs would be July 31,rather than the August 3 date in your <br /> proposed order. I would prefer to receive any trial brief by July 31. <br /> On the signature line for the attorneys,please change"Gale A.Norton,Attorney General" <br /> to"Colorado Attorney General's Office,State of Colorado."
