Linden <br /> RE: Trial Schedule in Mid-Continent Case <br /> I had a conference call with Judge Craven this morning. He has set the Mid-Continent <br /> case for trial for six days from August 7-14, 1998. The trial will be held in Glenwood Springs, <br /> and not in Aspen. Apparently, Aspen has limited facilities and 3 or 4 judges compete for <br /> courtroom space. The trial will be to the court rather than a jury trial. You will need to be <br /> available prior to trial in order to prepare for the trial, and to be available during the <br /> entire week of the trial since you may be called as a witness. <br /> Judge Craven set a pre-trial schedule as well. This includes completion of discovery <br /> by June 1. (1 sent Mike and Steve a document setting forth the discovery schedule. One is also <br /> attached to this memo). The completion of discovery entails serving or responding to additional <br /> interrogatories, conducting depositions and submitting a final list of witnesses to be called at trial <br /> and exhibits to be used at trial. <br /> After discovery is complete,the parties are required to file with the court a Trial <br /> Management Order by June 26; exchange all exhibits with opposing counsel on or before <br /> July 10; file all objections to exhibits on or before July 17 or such objections will have been <br /> waived; and prepare 3 sets of exhibit books for the court, opposing counsel and witnesses. The <br /> parties are required to deliver all exhibits marked as they will be used at trial to the court <br /> reporter by August 6. <br />
