It was unclear in
the initial report that the quarterly average for outfall 016-A was being reported. The
monitoring period on the report is 3/01/2012 to 3/31/2012 and the ‘no discharge’ box was
not marked. This gave the impression that discharge for the month of March 2012 was
being reported.

If this situation should arise again, please make it clear in the report that the quarterly
average is being reported.

Brock Bowles
Environmental Protection Specialist
Colorado Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, CO 80203

303-866-3567 ext. 8142

From: Jim Kiger [mailto:Jim.Kiger@OXBOW.COM]
Sent: Monday, April 30, 2012 3:12 PM
To: Bowles, Brock
Subject: RE: March DMR

This email is in response to the Division’s letter of April 30, 2012 asking for further explanation regarding the Outfall 016-
A in the March 2012 DMR.
When checked on 3/26/2012 during the quarterly pond inspection, the outfall weep was nothing more than a de-
minimis drip and not sampled.

However, the substantial flows of O16 had been sampled in January and February 2012 and no issues were noted (see
attached). The purpose of the March 2012 DMR report was to report only the Quarterly “Total Dissolved Solids”
consisting of averaging, in this case, the January and February samples. The quirk in the DMR’s is that the quarterly
reporting required in the third month of the quarter is independent of whether there was a discharge occurring in that
third month.

Please contact me if you have further questions.

James A.
