Hays <br />Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />f-11- <br />4-0 A=!�k <br />AGGREGATE <br />INDUSTRIES <br />Re: Permit M- 1992 -069 — 83rd Joint Venture Pit— Inspection Action Extension Request <br />Dear Peter: <br />The Division's report of an inspection conducted at the above - referenced site on February 10, 2012 <br />provided Aggregate Industries —T(A with certain options to gain compliance with regard to groundwater <br />exposure and required that Al take certain actions by varying dates dependent upon the option pursued. <br />The first option required that signed documentation be obtained from City of Greeley indicating that the <br />City is re- considering purchasing the property from the current property owner, 83rd Joint Venture (Hills) <br />and that such documentation be submitted to the Division by March 25. Hills met with the City and <br />believed that a letter indicating the City's interest in the property was forthcoming; however, the City <br />advised on March 21 that they had not made any decisions and would therefore be unable to provide a <br />letter by March 25. <br />Upon receiving the City's response, we contacted Hills again and requested a meeting to determine how <br />they wanted to proceed before the Division's alternative action date of April 24. They were unable to <br />accommodate the requested meeting until last Thursday, April 19, at which time Carl Hill advised that <br />they are financially unable to accomplish any of the options to bring the site into compliance and are <br />therefore asking Al how to proceed. <br />In consideration of AI's continued, diligent efforts to obtain cooperation from the land owner in resolving <br />this matter and the difficult position Al is now faced with, we respectfully request the Division's consent <br />to an extension of the corrective action due date in this matter.
