The letter that I sent stated that the BLM had not yet provided approval for the proposed mine <br />expansion, and that my staff would be completing the environmental analysis for the MCM Permit <br />Revision. After further consideration and discussions with the BLM Colorado State Office and the Office <br />of Surface Mining Reclamation and Enforcement ( "OSM ") this determination has changed. BLM will <br />not be completing the environmental analysis of the MCM PR -2 application since BLM is not the <br />deciding authority for the DRMS permit. Instead, as set forth in 30 C.F.R. § 906 et seq. (see Appendix <br />B), we will be providing comments to DRMS and OSM during the adequacy review and the <br />environmental analysis for the permit revision. BLM is still conducting the environmental analysis for <br />the McClave Mine lease modification application. <br />Before answering the questions you raised in your letter I would like to briefly discuss the roles and <br />responsibilities of the BLM, OSM, and DRMS in the federal coal permitting process. BLM is <br />responsible for initial leasing of federal coal reserves through competitive Lease by Applications <br />( "LBA ") and for subsequent non - competitive lease Modifications ( "MOD "). Following the <br />completion of leasing or lease modification of coal reserves the lease holder submits a Mine Plan <br />Permit Application to DRMS for review. DRMS reviews the permit application in cooperation with <br />OSM and BLM and is responsible for issuing a Mining and Reclamation Permit if the proposal is <br />approved. DRMS hag primacy on non - federal lands and responsibility on federal lands through a <br />cooperative agreement with the Secretary of the Interior ( "Secretary"). Approval of an additional <br />
