MINERALS PROGRAM INSPECTION REPORT

The Division of Reclamation, Mining and Safety has conducted an inspection of the mining operation
noted below. This report documents observations concerning compliance with the terms of the permit
and applicable rules and regulations of the Mined Land Reclamation Board.
The following inspection topics were identified as having Problems or Possible Violations. OPERATORS
SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE
WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a
Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land
Reclamation Board will consider possible enforcement action.
1. INSPECTION TOPIC: Hydrologic Balance
PROBLEM/POSSIBLE VIOLATION: Problem: The buffer zone located along the east and south
sides of the pit was removed through erosion during the 2011 high runoff event. Pursuant to 34-32.5 -
116(4)(h), the Division believes there has been a failure to minimize disturbances to the hydrologic
balance of the affected land and of the surrounding area, and to the quality and quantity of water in
surface and groundwater systems, both during and after the mining operation and during reclamation.
CORRECTIVE ACTIONS: An approvable technical revision to the permit, addressing
reconstruction and stabilization of the bank/buffer -zone, must be submitted to the Division within 30
days, with completion of the construction to be approved through the technical revision completed
within 90 days.

2. INSPECTION TOPIC: Reclamation Success
PROBLEM/POSSIBLE VIOLATION: Problem: The buffer zone located along the east and south
sides of the pit was removed through erosion during the 2011 high runoff event. The approved
Reclamation Plan required that an unmined buffer zone, 100 feet wide, remain in place. Compliance
with the approved Reclamation Plan will no longer be possible. Therefore, pursuant to C.R.S. 34-
32.5- 116(1), the Division believes there has been a failure to perform the reclamation prescribed by
the approved reclamation plan.
