This report documents observations concerning compliance with the terms of the permit <br />and applicable rules and regulations of the Mined Land Reclamation Board. <br />The following inspection topics were identified as having Problems or Possible Violations. OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />1. INSPECTION TOPIC: Hydrologic Balance <br />PROBLEM/POSSIBLE VIOLATION: Problem: The buffer zone located along the east and south <br />sides of the pit was removed through erosion during the 2011 high runoff event. Pursuant to 34-32.5 - <br />116(4)(h), the Division believes there has been a failure to minimize disturbances to the hydrologic <br />balance of the affected land and of the surrounding area, and to the quality and quantity of water in <br />surface and groundwater systems, both during and after the mining operation and during reclamation. <br />CORRECTIVE ACTIONS: An approvable technical revision to the permit, addressing <br />reconstruction and stabilization of the bank/buffer -zone, must be submitted to the Division within 30 <br />days, with completion of the construction to be approved through the technical revision completed <br />within 90 days. <br />CORRECTIVE ACTION DUE DATE: 4/19/12 <br />2. INSPECTION TOPIC: Reclamation Success <br />PROBLEM/POSSIBLE VIOLATION: Problem: The buffer zone located along the east and south <br />sides of the pit was removed through erosion during the 2011 high runoff event. The approved <br />Reclamation Plan required that an unmined buffer zone, 100 feet wide, remain in place. Compliance <br />with the approved Reclamation Plan will no longer be possible. Therefore, pursuant to C.R.S. 34- <br />32.5- 116(1), the Division believes there has been a failure to perform the reclamation prescribed by <br />the approved reclamation plan. <br />Page 1 of 4 <br />
