RE: Failure to Comply with Permit Conditions, Weimer Pit No.1, Permit No. M- 2001 -002 and Weimer
Pit No. 2, M- 1996 -031.
Dear Mr. Sutherland:
On July 19, 2011 the Division inspected the above referenced pits. The Division noted a noxious weed
problem at both sites and issued a problem in the inspection report with a correction date of October 31,
2011. To date the Division has not received the proper documentation noting the issue has been
addressed.
West End Gravel must submit a technical revision (TR) for a noxious weed control program for the sites per
Rule 3.1.10(6). The plan must be developed in conjunction with the Montrose Weed Control Authority. If
West End Gravel has met with the County then the TR should be submitted as soon as possible to clear the
problem from the record. If West End has not done so, then now is the time to develop and have
approved the plan so control measures may be undertaken this spring. West End Gravel must provide
proof to the Division of a meeting with the Montrose Weed Authority by February 3, 2012. Further the
required TR for the weed control plan must be submitted by February 21, 2012 to the Division. If West
End Gravel fails to respond the issue may be turned into a possible violation for failure to comply and
scheduled before the Mined Land Reclamation Board for possible civil penalties and corrective actions.
