Below is Jason Musick's adequacy review of Technical Revision TR59 for New Elk Coal Company's New EIk Mine.
Technical Revision TR59 was submitted in response to DRMS Notice of Violation CV- 2011 -003 for creating disturbances
at mine's surface facilities beyond approved permit and disturbance boundaries.
Attached also is Jason's reclamation cost estimate. The attached cost estimate does not include reclamation of the 500'
temporary conveyor, nor the 200' permanent conveyor, nor the 2 radial stackers, nor any concrete foundations for the
stackers and the permanent conveyor for the Refuse Disposal Area that were initially part of TR59. This is because it is
our understanding that these pieces of equipment will now be made part of the application for Minor Revision MR97 for
the New EIk Mine that is requesting a change in configuration of the maintenance corridor of the Refuse Disposal Area
conveyor.

Dan,
The following are the adequacy issues I have identified that are associated with TR59:

• Based on a review of the approved Map 13 in the PAP, the proposed disturbance area runoff of the addition
requested in TR59 is not delineated. Please have New Elk discuss the manner in which the proposed disturbed
area runoff will be collected and treated.
• Regarding proposed revised pages 2.05 -27, 2.05 -27a, and 2.05 -6a (Table 19), proposed revised Map 11 -Sheet 3,
and proposed revised Exhibit 28, please have New Elk revise these materials to remove references to the 200'
fixed conveyor, the 500' temporary conveyor, and demolition and mob /demo associated with the radial stacker
pads and conveyor footings. It's my understanding that these pieces of equipment will be addressed via Minor
Revision MR97, which the Division is also currently reviewing.
• The Division has compiled a reclamation cost estimate for the tasks associated with the reclamation of the C &W
Train Shop Facilities Area. This estimate is sufficient to reclaim all areas associated with the proposed addition
of facilities under TR59. Based on discussions with New Elk, the proposed 200 ft fixed conveyor, 500 ft temp.
