Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (DRMS) has reviewed the application for a technical <br />revision to the above referenced 112 permit. The purpose of the technical revision is to update the mining <br />phase sequence and maximum allowable disturbance for the operation. The site is a 40 acre 112c <br />operation with a current maximum allowable disturbance of 20.6 acres. A review of the application has <br />revealed a few issues and clarifications to address. <br />1) According to the map submitted with the technical revision the stockpile locations shown on the <br />map indicate that the overburden and topsoil are stockpiled together. Per Rule 3.1.9(1), where it <br />is necessary to remove overburden in order to mine the construction material, topsoil shall be <br />removed and segregated from other spoil. Please clarify whether or not the topsoil is mixed with <br />the overburden. In the case that the two are mixed provide an explanation of what measures will <br />be implemented to separate the topsoil from the overburden. <br />2) Please clarify what phases remain to be mined. The figure provided does not indicate what areas <br />remain to be mined or what area is currently disturbed. Please clarify what acreage of <br />disturbance currently exists at the site. <br />The technical revision cannot be approved until the issues are adequately addressed. Please submit a <br />response to the issues as soon as possible but no later than November 28, 2011, so the decision date of <br />December 16, 2011 can be met.
